NEW DELHI: In allowing the Char Dham project and ensuring environmental protection, the Supreme Court on Tuesday, December 14, stated that the jurisprudence of sustainable development is deeply embedded in Indian environmental law, which ensures inter and intra-generational environmental equity.
The bench, headed by Justice DY Chandrachud, Vikram Nath and Surya Kant, underlined that the report on the indicated project was riddled with issues that are important to be resolved in order to make it environmentally sustainable. The bench further said that with sustainable development having an important place in Indian environmental law, it has emerged as a multi-faceted aspect that does not stop the development, but structures it sustainably.
Sustainable development functions on two core ideas- firstly, the sort of development which ensures equity between the present and future generations along with establishing equity between the different sections of society as well, said the panel while counting on the parameters imperative for sustainable development.
